FandomIQ Studio (Beta)

User Service Agreement

Effective Date: 1st November 2025

Parties: FandomIQ, Inc. (“FandomIQ,” “we,” “our,” or “us”) and the individual end user (“you” or “user”).

1. Beta Program Overview

FandomIQ Studio is an experimental beta service available to a limited number of users. Features, performance, and access may change at any time. Participation does not guarantee continued access or future availability.

2. Eligibility

You must be at least 18 years old and legally able to enter into this Agreement. You agree that the information you provide is accurate.

3. Fees and Payments

  • A one-time fee provides access to the beta.

  • Future non-beta access will require a separate subscription, with pricing subject to change.

  • Payments are processed securely through Stripe; we do not store card details.

  • All payments must be authorized by the account holder.

  • All amounts are in USD.

  • No refunds or credits are offered for beta access or unused service time.

Paying for the beta does not grant any rights to future versions or continued service.

4. Proprietary Rights

FandomIQ Studio and all underlying software, models, algorithms, designs, and data are the exclusive property of FandomIQ. This Agreement grants you a limited right to use the beta; no ownership or licensing rights are transferred.

5. Code of Conduct

You agree not to create, upload, or share content that:

  1. Violates applicable laws, including U.S. federal law, California law, or the laws of your local jurisdiction.

  2. Violates the rights of others, including privacy, IP, or contractual rights.

  3. Promotes or facilitates harmful or illegal activity, including violence, exploitation, human trafficking, or self-harm.

  4. Contains harassment, hate speech, or credible threats, including against protected classes.

  5. Spreads intentionally misleading or harmful information.

  6. Is sexually exploitative, including child sexual abuse content or non-consensual sexual material.

  7. Doxxes or expose private information without consent.

  8. Contains malware, spam, or other disruptive content.

Because real-world context varies, FandomIQ may interpret and enforce these rules using reasonable judgment, considering potential harm, user intent, and platform safety.

We may remove content or restrict access if we believe you have violated this section.

6. Your Content Responsibilities

You are fully responsible for any content you upload or generate using the service, including ensuring you have the necessary rights. FandomIQ does not provide copyright clearance and is not responsible for legal claims arising from your content.

If we receive a credible complaint that your content violates this Agreement or applicable law, we may investigate, remove content, or suspend your account.

7. AI-Generated Output

The service may produce content using automated systems (including AI/LLMs). Output may be inaccurate, incomplete, biased, or inappropriate.
You agree to:

  • Review and verify any output before using it

  • Do not rely solely on AI-generated content for important decisions

  • Accept responsibility for how you use or share AI-generated material

FandomIQ does not guarantee output accuracy or suitability.

8. Use of Data to Improve the Service

You permit FandomIQ to use your interactions, metadata, and usage patterns to operate and improve our systems, including tuning or evaluating models.
All resulting technology, data, and improvements remain owned by FandomIQ.

9. Third-Party Services and Availability

The beta relies on third-party services, including cloud hosting, AI model providers, and payment processors.
Because of this:

  • We do not guarantee uptime or uninterrupted service

  • Outages, delays, or degraded performance may occur

  • FandomIQ is not liable for failures caused by third-party providers

10. Privacy and Cookies

Your information is handled in accordance with our Privacy Policy.

Do not upload sensitive or confidential information while the service is in beta.

11. Order Confirmation

Your beta access or purchase is considered complete once we send a confirmation email, access credentials, or digital receipt.

12. Data Storage

We do not guarantee storage or backup of your content or AI output.
Please save anything you want to keep.

13. Security

We use reasonable measures to secure the service, but no system is perfectly secure. You use the beta at your own risk.

14. High-Risk Use & Moderation Authority

You may not use the service in high-risk contexts where errors could cause serious harm, including medical, emergency, aviation, nuclear, or military environments.

FandomIQ may review, remove, restrict, or moderate content or accounts if:

  • We believe you may be violating this Agreement

  • We receive credible complaints

  • Required by law

  • We determine that action is necessary to maintain user or platform safety

We may interpret and enforce these rules in our sole discretion.

We may suspend or terminate accounts without notice if needed to protect users, the public, or the platform.

15. No Professional Advice

AI outputs and service content do not constitute legal, financial, medical, or other professional advice.

16. Account Suspension

We may suspend or end your access at any time for violations or risk of harm. No refunds are issued.
You may stop using the beta at any time.

17. Feedback

If you provide feedback or suggestions, you grant FandomIQ permission to use them without restriction or compensation.

18. Limitation of Liability

To the fullest extent allowed under California law:

  • The beta is provided “as is” and “as available.”

  • We disclaim all implied warranties.

  • We are not liable for indirect or consequential damages, including lost profits, lost data, or business interruption.

  • You use the beta at your own risk.

19. Indemnification

If someone brings a claim related to your use of the service, your content, or your violation of this Agreement, you agree to defend and indemnify FandomIQ from all claims, damages, and expenses (including reasonable legal fees).
We may assume control of the defense, and you agree to cooperate.

20. Export Compliance

You must comply with applicable export and sanctions laws. You may not use the service if you are in a restricted jurisdiction or on a government-prohibited list.

21. Dispute Resolution; Waiver of Jury Trial & Class Actions

To the extent allowed by law:

  • You waive the right to a jury trial

  • You waive participation in class actions or class-wide arbitration

  • Disputes must be resolved individually in the courts located in San Diego, California

22. Changes to This Agreement

We may update these terms. Continued use of the beta means you accept any updates.
